SOPHER SIMLAH
TERMS & CONDITIONS
Last updated: September 2026
Welcome to Sopher Simlah. These Terms & Conditions govern your use of the Sopher Simlah website and your purchase of products through our online store.
By placing an order through our website, you acknowledge that you have read and understood these Terms & Conditions and agree to be bound by them, together with our applicable policies.
Sopher Simlah operates in accordance with applicable South African consumer and e-commerce legislation, including the Consumer Protection Act 68 of 2008 (CPA) and the Electronic Communications and Transactions Act 25 of 2002 (ECTA).
Nothing in these Terms & Conditions is intended to exclude or limit any right that you have under applicable South African law.
1. ABOUT SOPHER SIMLAH
Sopher Simlah is a clothing brand offering thoughtfully designed garments and products through our online store.
We aim to provide accurate product descriptions, images, sizing information and care instructions so that customers can make informed purchasing decisions.
All product descriptions and specifications are provided in good faith. While we make every reasonable effort to ensure that colours, measurements and product details displayed on the website are accurate, slight variations may occur due to screen settings, manufacturing processes and the natural characteristics of the fabrics used.
2. PRODUCTS & AVAILABILITY
All products are subject to availability.
We reserve the right to discontinue products, change product specifications, or correct errors in product descriptions or pricing where necessary.
If an item you have ordered becomes unavailable after your order has been placed, we will contact you and, where applicable, offer an appropriate remedy, including a refund.
We endeavour to ensure that all product information and pricing displayed on the website is accurate. If an obvious pricing or product description error occurs, we will contact you before processing the order where reasonably possible.
3. FABRIC & NATURAL CHARACTERISTICS OF OUR GARMENTS
100% Cotton
Unless otherwise stated on the individual product page, Sopher Simlah garments are made from 100% cotton.
Cotton is a natural fibre and, as such, may naturally change slightly with washing and wear.
Cotton garments can shrink when exposed to high heat, particularly when tumble dried.
Customers are therefore required to follow the specific washing and care instructions provided for each garment.
The applicable care instructions will be displayed alongside the relevant product description on our website and will also be included with your order.
4. WASHING & CARE OF GARMENTS
Please read the care instructions before washing your garment for the first time.
The care instructions provided with your garment form an important part of the product information.
Customers are responsible for following these instructions.
Tumble drying
Our 100% cotton garments WILL shrink if tumble dried, particularly at higher temperatures.
Unless the care instructions for a specific product expressly state otherwise, we recommend that Sopher Simlah garments are not tumble dried.
Customers should follow the washing, drying, ironing and other care instructions supplied with the garment.
Sopher Simlah cannot accept responsibility for shrinkage, distortion, fading, damage, deterioration or other changes to a garment resulting from:
-
tumble drying where it is not permitted by the care instructions;
-
washing at temperatures higher than recommended;
-
incorrect washing cycles;
-
use of unsuitable detergents, bleach or other chemicals;
-
failure to follow drying instructions;
-
excessive heat;
-
ironing at an unsuitable temperature; or
-
any other negligent or incorrect care of the garment.
Damage caused by failure to follow the supplied care instructions will not be treated as a manufacturing defect.
This provision does not limit or exclude any rights the customer may have under applicable South African consumer law.
5. PLACING AN ORDER
When you place an order through the Sopher Simlah website, you are making an offer to purchase the selected products.
You will receive an electronic confirmation of your order.
An order will only be considered accepted once payment has been successfully received and the order has been accepted for fulfilment by Sopher Simlah.
We reserve the right to decline or cancel an order where:
-
the product is unavailable;
-
there has been an obvious pricing or product-description error;
-
payment has not been successfully processed;
-
fraudulent activity is suspected; or
-
circumstances outside our reasonable control prevent fulfilment.
Where an order is cancelled after payment has been received, any applicable refund will be processed in accordance with the customer's legal rights and our refund policy.
6. PRICES & PAYMENT
All prices displayed on the website are stated in South African Rand (ZAR).
The applicable price is the price displayed at the time the order is placed, subject to obvious errors.
Where applicable, delivery charges will be displayed before the customer completes the purchase.
Payment must be made using the payment methods made available through the website.
We do not store complete payment-card details where payment is processed through an authorised third-party payment provider.
7. DELIVERY
We will provide an estimated delivery timeframe on the website or during the ordering process.
Delivery times are estimates and may be affected by circumstances outside our reasonable control, including courier delays, public holidays, adverse weather, strikes, or other unforeseen events.
We will make reasonable efforts to ensure that orders are dispatched within the timeframe communicated to the customer.
If an order cannot be fulfilled within the agreed or applicable timeframe, the customer will retain any cancellation rights available under South African law.
Customers are responsible for providing an accurate delivery address and contact information.
Sopher Simlah cannot be held responsible for delays or failed deliveries resulting from an incorrect or incomplete address supplied by the customer.
8. INSPECTION UPON DELIVERY
Customers are encouraged to inspect their order as soon as reasonably possible after delivery.
If you believe that you have received:
-
the incorrect product;
-
an incorrect size;
-
a damaged product;
-
a product with a manufacturing defect; or
-
a product that does not correspond materially with its description,
please contact us as soon as possible with your order number and photographs of the relevant item.
We will assess the matter and provide the appropriate remedy in accordance with applicable law.
9. RETURNS, EXCHANGES & REFUNDS
Sopher Simlah respects all consumer rights applicable to online purchases under South African law.
9.1 Statutory cooling-off rights
Where applicable, customers have the right under the Electronic Communications and Transactions Act to cancel a qualifying electronic transaction within seven days after receipt of the goods, without giving a reason and without penalty, subject to the exceptions provided by law.
Where this statutory cooling-off right applies, the customer may be responsible for the direct cost of returning the goods.
The goods must be returned in accordance with the applicable legal requirements.
9.2 Unwanted or change-of-mind returns
Where Sopher Simlah offers a return or exchange beyond the customer's statutory rights, the applicable conditions will be stated in our Returns & Refunds Policy.
Unless otherwise required by law, garments returned for a voluntary change-of-mind return should be:
-
unworn;
-
unwashed;
-
undamaged;
-
free from stains, odours, makeup, deodorant or other marks;
-
returned with original tags and packaging where applicable; and
-
in a condition suitable for resale.
For hygiene and quality-control reasons, we may refuse voluntary returns where the garment has been worn, washed, damaged or otherwise altered by the customer, subject always to the customer's statutory rights.
9.3 Defective or incorrect products
If a product is defective, unsafe, or does not meet the standards required by applicable consumer law, the customer may have rights to a repair, replacement or refund as provided by law.
A manufacturing defect is different from damage caused by ordinary wear, misuse, accidental damage or failure to follow the supplied care instructions.
10. SHRINKAGE & CARE-RELATED DAMAGE
Because Sopher Simlah garments are made from 100% cotton, some natural movement of the fabric may occur during washing.
The customer acknowledges that:
Tumble drying can cause significant shrinkage to 100% cotton garments.
Care instructions are provided:
-
on the relevant product page before purchase; and
-
inside the customer's parcel when the order is delivered.
Customers are expected to read and follow these instructions.
Where a garment has been washed or dried contrary to the supplied care instructions, any resulting shrinkage, distortion, fading, damage or deterioration will not ordinarily constitute a manufacturing defect.
Sopher Simlah will assess any disputed claim fairly and in accordance with applicable South African law.
11. GARMENT COLOUR & APPEARANCE
Natural fabrics and dyes may display minor variations in colour, texture and finish.
Colours shown on a customer's screen may also differ slightly from the physical garment depending on the device, display settings and lighting conditions.
Such minor variations do not necessarily constitute a defect.
